Shipping & Delivery Policy – Drive Y Dream Limited

- 1.1. This Shipping & Delivery Policy ("Policy") sets out the terms under which prizes won in competitions operated by Drive Y Dream Limited ("Promoter", "we", "our") will be delivered to winners.
- 1.2. This Policy forms part of our Terms and Conditions and should be read in conjunction with them.
- 1.3. By participating in our competitions, winners acknowledge and agree to comply with the delivery terms outlined herein.
- 2. Prize Delivery Responsibility
- 2.1. The Promoter will arrange delivery or collection of prizes strictly in accordance with this Policy.
- 2.2. All delivery arrangements will be made directly with the verified winner after confirmation of eligibility and completion of any required identity checks.
- 2.3. The Promoter will not release any prize until the winner has satisfied all requirements set out in the Terms and Conditions, including but not limited to age verification, proof of residency, and acceptance of the prize.
- 3. Delivery Costs
- 3.1. Unless otherwise stated in the specific competition listing, the Promoter will cover reasonable standard delivery costs for winners located within the United Kingdom.
- 3.2. For winners outside the United Kingdom, all international shipping costs, customs duties, import taxes, local registration fees, and any other charges imposed by the destination country will be the sole responsibility of the winner.
- 3.3. The Promoter will not be liable for any delays, additional costs, or refusal of entry by customs authorities in the winner's jurisdiction.
- 4. Delivery Timescales
- 4.1. Delivery or collection arrangements will be agreed upon within 30 days of the winner being notified, unless otherwise specified in the competition listing.
- 4.2. Actual delivery times will vary depending on the nature of the prize, availability, and the location of the winner.
- 4.3. Where applicable, the Promoter will provide an estimated delivery date, but this shall not constitute a binding commitment.
- 4.4. The Promoter is not liable for delays caused by events beyond its reasonable control, including manufacturing delays, transportation strikes, or customs inspections.
- 5. Prize Collection Option
- 5.1. At the Promoter's discretion, winners may be given the option to collect the prize in person from a specified location within the United Kingdom.
- 5.2. If the winner opts for collection, they must do so within 30 days of the collection date being agreed.
- 5.3. Any costs associated with travel, accommodation, or personal arrangements for collection will be borne entirely by the winner.
- 5.4. The Promoter reserves the right to require a signed collection receipt and photographic evidence of collection.
- 6. Transfer of Ownership and Risk
- 6.1. Ownership of the prize will transfer to the winner only once:
- The prize has been fully handed over to the winner or their authorised representative; and
- All required verification and documentation have been completed.
- 6.2. Risk of loss, damage, or theft passes to the winner at the moment the prize is delivered to them or their authorised representative, or when they collect it in person.
- 6.3. The Promoter is not responsible for any loss or damage occurring after delivery or collection has taken place.
- 7. Insurance During Transit
- 7.1. Unless otherwise stated, prizes shipped within the United Kingdom will be covered by the Promoter's standard transit insurance until delivery is completed.
- 7.2. For international deliveries, the Promoter will arrange basic transit insurance where possible; however, the winner is responsible for arranging additional coverage if required.
- 7.3. The Promoter accepts no liability for losses where the winner has declined to arrange or extend insurance beyond the Promoter's coverage.
- 8. Regulatory and Legal Requirements
- 8.1. For prizes such as vehicles or other items requiring licensing, registration, or certification, the winner is solely responsible for:
- Complying with local laws and regulations;
- Arranging for registration, insurance, and inspection;
- Paying any applicable fees, taxes, or charges.
- 8.2. The Promoter will provide reasonable assistance by supplying necessary documentation, but will not bear any associated costs.
- 8.3. If the winner fails to meet legal requirements in their jurisdiction, the Promoter may deem the prize forfeited without compensation.
- 9. Non-Receipt and Claims
- 9.1. If the winner does not receive the prize within the estimated timeframe, they must notify the Promoter in writing within 7 days of the expected delivery date.
- 9.2. Failure to notify the Promoter within this period may result in the claim being refused.
- 9.3. The Promoter will investigate any valid claim with the relevant delivery or courier service, and the resolution may include repair, replacement, or reshipment of the prize, at the Promoter's sole discretion.
- 10. Delivery Appointments and Absences
- 10.1. If a delivery appointment is required, the winner must ensure they or an authorised representative are present at the agreed date and time.
- 10.2. If delivery cannot be completed due to the winner's absence, they will be responsible for any redelivery charges or storage fees imposed by the courier or delivery service.
- 10.3. The Promoter is not liable for deterioration, damage, or additional costs arising from missed delivery appointments caused by the winner.
- 11. Customs Seizure or Detention
- 11.1. For prizes delivered outside the United Kingdom, the winner is solely responsible for ensuring that the prize complies with all import regulations in their country.
- 11.2. The Promoter is not liable for delays, seizures, confiscations, or destruction of the prize by customs or other regulatory authorities.
- 11.3. Any costs, fines, or losses incurred as a result of such actions are the sole responsibility of the winner.
- 11.4. If a prize is returned to the Promoter due to customs refusal, the winner will be responsible for all return shipping costs, re-delivery costs, and any applicable storage or handling charges.
- 12. Damage on Delivery
- 12.1. The winner must inspect the prize immediately upon delivery or collection.
- 12.2. Any visible damage must be reported to the delivery driver and noted on the delivery receipt before signing.
- 12.3. Any hidden damage must be reported to the Promoter in writing within 48 hours of delivery, accompanied by photographic evidence.
- 12.4. Failure to report damage within the specified timeframe may result in the Promoter declining any claim for repair or replacement.
- 13. Refusal to Accept Delivery
- 13.1. If the winner refuses delivery without a valid reason (such as significant damage), the prize will be deemed forfeited.
- 13.2. In such cases, the Promoter will have no further obligation to the winner and may, at its discretion, offer the prize to an alternate winner or reallocate it in a future competition.
- 13.3. Any costs incurred due to refusal of delivery without valid cause will be charged to the winner.
- 14. Force Majeure
- 14.1. The Promoter will not be liable for any delay or failure to deliver a prize caused by events beyond its reasonable control, including but not limited to:
- Natural disasters;
- War, terrorism, or civil unrest;
- Industrial strikes or disputes;
- Transport or courier disruptions;
- Governmental restrictions or regulations.
- 14.2. In such cases, the delivery timeline may be extended, or alternative arrangements may be made at the Promoter's discretion.
- 15. Final Provisions and Contact Information
- 15.1. This Policy forms part of the contractual agreement between the Promoter and the winner and should be read in conjunction with our Terms and Conditions and Acceptable Use Policy.
