Terms & Conditions – Drive Y Dream Prize Competition
- 1. Introduction
- These Terms and Conditions ("Terms") govern all aspects of participation in the Drive Your Dream Prize Competition ("Competition") operated by Drive Y Dream Limited, a company incorporated in England and Wales under company number 16535997, with its registered office at 85 Great Portland Street, First Floor, London, England, W1W 7LT ("Promoter"). By entering the Competition, all entrants agree to be bound by these Terms, which are final and binding in all matters related to the Competition. The Promoter reserves the right to amend these Terms at any time without prior notice where such changes are required to comply with applicable laws and regulations or to ensure the proper administration of the Competition.
- 2. Definitions
- In these Terms:
- "Promoter" means Drive Y Dream Limited, the organiser and operator of the Competition.
- "Entrant" means any individual who participates in the Competition in accordance with these Terms.
- "Prize" means the item described in the relevant Competition listing, which may include, but is not limited to, luxury cars or high-performance motorcycles.
- "Skill Question" means the question of skill, knowledge, or judgement that must be correctly answered to qualify for entry into the final draw.
- "Free Entry Route" means the alternative, non-paid method of entry described in Clause 6.
- 3. Eligibility
- 3.1. The Competition is open only to natural persons aged 18 years or older at the date of entry. Proof of age may be required before any Prize is awarded.
- 3.2. Entrants must be resident in the United Kingdom or in jurisdictions where participation in such skill-based competitions is lawful. It is the Entrant's sole responsibility to ensure that participation is permitted under their local laws.
- 3.3. The following persons are not eligible to participate: employees, agents, and contractors of the Promoter, any associated companies, and their immediate family members (spouse, parent, sibling, child).
- 3.4. The Promoter reserves the right to verify the eligibility of any Entrant and to disqualify entries that do not meet the eligibility criteria.
- 4. Nature of the Competition
- 4.1. This is a skill-based prize competition. It does not constitute a lottery or form of gambling under the Gambling Act 2005.
- 4.2. Entry into the Competition requires the successful completion of a Skill Question. Only entries with a correct answer to the Skill Question will be entered into the final draw to determine the winner.
- 4.3. The level of difficulty of the Skill Question will be sufficient to ensure that the Competition is genuinely a test of skill, knowledge, or judgement and not merely a game of chance.
- 4.4. The Promoter may change the Skill Question from time to time without prior notice, provided that all Entrants have an equal opportunity to answer the updated question.
- 5. How to Enter
- 5.1. Entrants must first select the Competition they wish to enter on the Promoter's website, answer the Skill Question, and then complete the purchase of the selected number of entries via the online payment system.
- 5.2. The cost per entry and the maximum number of entries permitted per Entrant for each Competition will be stated clearly on the Competition listing page.
- 5.3. An Entrant who answers the Skill Question incorrectly will not be entered into the draw and will not be entitled to any refund of the entry fee.
- 5.4. Entries must be received before the published closing date and time for the Competition. Late entries, regardless of the reason, will not be accepted.
- 5.5. All online entries are deemed to be received at the time the Promoter's database records the entry, not at the time of transmission by the Entrant.
- 6. Free Entry Route
- 6.1. The Promoter offers a free alternative method of entry to comply with applicable laws and advertising codes. Entrants may enter the Competition without making a purchase by sending a legibly handwritten postcard or letter by first-class post to: Drive Y Dream Limited, 85 Great Portland Street, First Floor, London, England, W1W 7LT.
- 6.2. The written entry must include: the Entrant's full name, postal address, email address, telephone number, the name of the Competition, and the answer to the Skill Question.
- 6.3. Free entries must be received by the Promoter no later than the published closing date for the Competition. Entries received after the closing date will be invalid.
- 6.4. Free entries are processed in exactly the same manner as paid entries, and only those with a correct answer to the Skill Question will be entered into the draw.
- 6.5. Multiple free entries from the same Entrant must each be sent on separate postal items. The Promoter will reject any batch submissions.
- 7. Competition Closing Date
- 7.1. The closing date for each Competition will be clearly stated on the Competition listing page.
- 7.2. The Promoter may, at its discretion, bring forward the closing date if all available entries for that Competition have been sold before the scheduled end date.
- 7.3. Once the closing date has passed, no further entries will be accepted.
- 7.4. In exceptional circumstances, the Promoter may extend the closing date to ensure fairness or in the event of unforeseen operational issues. Any such extension will be communicated via the Promoter's website and social media channels.
- 7.5. The Promoter is not responsible for any delay, technical malfunction, or event that prevents timely entry submission.
- 8. Selection of the Winner
- 8.1. All eligible entries with the correct answer to the Skill Question will be entered into the final draw.
- 8.2. The draw will be conducted either live or through a secure random number generator that is independently verifiable.
- 8.3. The draw will be supervised by an independent adjudicator to ensure fairness and transparency.
- 8.4. The Promoter reserves the right to record and publish the draw for promotional purposes, subject to applicable privacy laws.
- 8.5. The result of the draw is final and no correspondence will be entered into regarding the outcome.
- 9. Notification of the Winner
- 9.1. The winner will be contacted within seven (7) days of the draw via the contact details provided on their entry.
- 9.2. If the winner cannot be contacted or fails to respond within fourteen (14) days of notification, the Promoter reserves the right to withdraw the prize and select an alternative winner from the remaining eligible entries.
- 9.3. The Promoter may require the winner to provide proof of identity, age, and eligibility before the prize is awarded.
- 9.4. Failure to provide such proof within the specified time will result in disqualification.
- 9.5. The Promoter will not be responsible for any inability to contact the winner due to incorrect contact information provided at the time of entry.
- 10. The Prize
- 10.1. The prize will be as described in the Competition listing, including make, model, and relevant specifications.
- 10.2. The prize is non-transferable and no cash or other alternative will be offered.
- 10.3. The winner is solely responsible for any costs associated with the prize, including but not limited to insurance, registration, vehicle licensing, servicing, maintenance, fuel, and any applicable local taxes.
- 10.4. If the winner resides outside the United Kingdom, they will also be responsible for all import duties, customs clearance fees, shipping costs, and any other charges imposed by the destination country, including compliance with any local laws or regulations for the import and use of the prize. This applies regardless of whether the winner is located within the European Union, Australia, or any other jurisdiction.
- 10.5. If the prize becomes unavailable for reasons beyond the Promoter's control, the Promoter reserves the right to substitute it with a prize of equal or greater value.
- 10.6. The Promoter does not accept liability for any defects in the prize once handed over to the winner, and any such issues must be addressed directly with the manufacturer or supplier.
- 11. Publicity and Marketing
- 11.1. By entering the Competition, each Entrant consents to the use of their name, likeness, photograph, and general location by the Promoter for the purposes of announcing the winner and for any reasonable promotional purposes, both online and offline, without further compensation.
- 11.2. The winner agrees to participate in promotional activities reasonably requested by the Promoter, which may include interviews, social media posts, photographs, and videos.
- 11.3. If the winner reasonably objects to the use of their image or personal details for publicity purposes, they must notify the Promoter in writing within 48 hours of accepting the prize.
- 11.4. The Promoter reserves the right to publish anonymised information if the winner refuses publicity.
- 12. Refund Policy
- 12.1. Entry fees are non-refundable except in circumstances where the Competition is cancelled by the Promoter before the closing date.
- 12.2. If the Competition is cancelled, all Entrants will be offered either a full refund of their entry fee or the option to transfer their entry to another Competition of equal or lesser value.
- 12.3. Refunds will only be made to the original payment method and may take up to 14 business days to process.
- 12.4. No refund will be given to Entrants who provide incorrect answers to the Skill Question or who are otherwise disqualified under these Terms.
- 13. Data Protection and Privacy
- 13.1. The Promoter will process all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- 13.2. Entrants' personal data will be used solely for the purposes of administering the Competition, contacting winners, and fulfilling the prize.
- 13.3. The Promoter will retain Entrants' personal data only for as long as is necessary for the purposes for which it was collected or as required by law.
- 13.4. Entrants have the right to request access to, rectification of, or erasure of their personal data at any time by contacting the Promoter in writing.
- 13.5. The Promoter will not share personal data with third parties except where necessary for prize delivery, Competition administration, or as required by law.
- 14. Limitation of Liability
- 14.1. The Promoter will not be liable for any loss, damage, or injury suffered by any Entrant arising out of or in connection with the Competition or the prize, except where such liability cannot be excluded by law.
- 14.2. Nothing in these Terms shall limit or exclude the Promoter's liability for death or personal injury caused by its negligence, fraud, or fraudulent misrepresentation.
- 14.3. The Promoter accepts no responsibility for any entries that are lost, delayed, corrupted, or otherwise not received due to technical, postal, or other reasons beyond its control.
- 14.4. The winner accepts the prize entirely at their own risk and is responsible for ensuring the prize complies with any local laws, insurance requirements, and safety standards applicable in their jurisdiction.
- 15. Disqualification
- 15.1. The Promoter reserves the right to disqualify any Entrant found to be in breach of these Terms or to have provided false information during the entry process.
- 15.2. Multiple entries made through any automated method, or entries made using false identities or details, will be void.
- 15.3. Any evidence of fraud, cheating, or manipulation of the Competition process will result in immediate disqualification and may lead to legal action.
- 15.4. Disqualified Entrants will forfeit any rights to the prize and no refund will be issued.
- 16. Governing Law and Jurisdiction
- 16.1. These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
- 16.2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Competition.
- 16.3. Entrants located outside the United Kingdom must comply with all applicable laws of their jurisdiction before participating, and the Promoter makes no representation that participation is lawful in any particular jurisdiction.
- 17. Force Majeure
- 17.1. The Promoter shall not be liable for any failure to perform, or delay in performance, of any of its obligations under these Terms that is caused by events outside its reasonable control ("Force Majeure Event").
- 17.2. Force Majeure Events include, but are not limited to, natural disasters, acts of terrorism, war, civil commotion, pandemics, labour disputes, governmental actions, failure of public or private telecommunications networks, and breakdown of internet service providers.
- 17.3. In such cases, the Promoter reserves the right to cancel, suspend, or amend the Competition without incurring any liability.
- 18. Entire Agreement
- 18.1. These Terms constitute the entire agreement between the Promoter and the Entrant with respect to the Competition and supersede all prior agreements, negotiations, and understandings, whether oral or written.
- 18.2. No variation of these Terms shall be effective unless it is in writing and signed by an authorised representative of the Promoter.
- 18.3. If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining Terms, which shall remain in full force and effect.
- 19. Intellectual Property Rights
- 19.1. All intellectual property rights in the Competition, including but not limited to the website, promotional materials, branding, and logos, are owned by or licensed to the Promoter.
- 19.2. No part of the Competition materials may be reproduced, distributed, or otherwise exploited without the prior written consent of the Promoter.
- 19.3. Entrants may not use the Promoter's name, trademarks, or logos without express written permission.
